Terms & Conditions

1. Definitions

(a) In these conditions, 'the Company' shall mean Scope Furnishing Ltd., trading as Furniture Zone.  'The customer' shall mean the person, firm or company to whom any quotation or order is addressed or with whom any contract is made.  'The goods' shall mean the goods agreed to be sold on this internet site.  'The place of delivery' shall mean the place of delivery that is requested by the customer.  'The manufacturer' shall mean any company or person supplying or manufacturing any goods for the company on behalf of the customer.  'Delivery agent' shall mean any company contracted by Scope Furnishing Ltd to accept deliveries from the Manufacturer and deliver the same goods to the customer.

2.  Law

The rights and obligations of the Company and of the Customer shall be governed by and construed in accordance with the laws of the Island of Guernsey and the Courts of the Island of Guernsey shall have none exclusive jurisdiction over all disputes arising.

3. Application of These Conditions

(a)  All quotations given and all contracts made by the Company are subject to the Terms and Conditions shown herein.

(b)  Quotations issued by the Company are not offers capable of acceptance as to make a binding contract.

(a)  Each delivery hereunder shall constitute a separate contract.  The Customer shall take delivery of the goods at the place of delivery with reasonable dispatch and subject to written notice from the Customer in accordance with Clause 4b shall be deemed to have been delivered complete and in a satisfactory condition.

(b)  If, on delivery, the Customer finds the goods to be faulty or incorrect, the Customer must notify the Company in writing within seven days, or ought with reasonable diligence to have been discovered.  Otherwise all claims by the Customer shall be deemed to be waived and absolutely barred.  This does not affect the Customer's Statutory Rights.

(c)  Once the Delivery Agent has receipt of the goods from the Manufacturer, the Customer will be notified within reasonable time, subject to the order being paid for in full.  After notification to the Customer by the Delivery Agent, delivery must take place within fourteen days, or subject to an agreement in writing between the Customer and the Delivery Agent.  If the goods cannot be delivered and no agreement exists, a storage charge will be made, this will be at the Delivery Agents or Company's discretion.

(d)  If, on delivery, the goods cannot be successfully delivered into the place of delivery due to any reason, the Company and Delivery Agent are not liable whatsoever for taking the goods back into their warehouse.  It is the Customer's responsibility to ensure that access is adequate for the size of the goods, and or the size of delivery vehicle, including driveways, roads, doorways, stairways and any other object or cause that may obstruct the delivery.  If for any reason whatsoever, the Delivery Agent cannot deliver the goods successfully and has to return to the delivery address at another time, another delivery charge will be applicable.  It is the Customer's responsibility to ensure that the delivery takes place on the day and approximate time agreed between the Customer and Delivery Agent.

Delivery dates mentioned in any quotation or order, are given in good faith, but are approximate only, and are of no contractual effect.  

Deliveries can only be undertaken from Monday to Friday during normal office hours. The Company will not be liable for any loss, delay or damage due to the Manufacturer or Delivery Agent for any reason whatsoever.  If the Company is hindered or prevented from obtaining, transporting, delivering or arranging the delivery of goods by war, strikes, riots, blockades, acts of God, delay from the Manufacturer for any reason or without prejudice to the generality of the foregoing any other clause whatsoever beyond the control of the Company, the time for the delivery shall be at the Company's option be extended accordingly and this Clause shall apply to the new date or dates of delivery.

Orders are accepted on the strict understanding that they will be paid by the Customer in full before the date of delivery.  The deposit taken at the time of order will not be refunded for any reason whatsoever unless the goods shown on the order cannot be supplied by the Manufacturer.  After a period not exceeding seven days from the date shown on the order, the Company will assume that the Customer agrees to the Contract in every detail.

All prices shall be as stated by the Company.  Any discounts, quotes or special offers will only by applicable at the time of display, or within forty eight hours should the price be a quote.

In the event that the Customer requires a variation or cancellation of delivery, the same shall only be effective with the written consent of any agent of the Company and an undertaking (hereby deemed to have been given) to wholly indemnify the Company against any charges or expenses incurred as a result of any such cancellation.  In any event, should the customer wish to cancel the order, it must be done within seven days of the date of the order confirmation.  All orders are made to the customer's specifications therefore, after the period of seven days, the order will be in process with the manufacturer.  If the order is cancelled within the seven days stated above, the customer will receive all monies owed to him, including his/her deposit but less any costs that may have been incurred by the company in canceling the order.  If the order is cancelled after this period, the company will do it's utmost to cancel the order with the manufacturer.  The customer will not receive a refund on his/her deposit.  If the order cannot be cancelled due to the product having been already produced for the customer, or the product has been dispatched, the customer will be legally bound to pay all monies owed, which will be shown on the confirmation invoice.

8. Quotes

All quotes will be given in good faith and will remain valid for a period not exceeding forty eight hours after the quotes issue.  The company, when issuing a quote, will provide a quote number to the customer.  This quote number must be given to the company by the customer should the customer wish to take advantage of the quote.  All quotes will expire after forty eight hours after issue and will be deemed null and void.

8. Liability

Whilst the Company makes considerable effort in ensuring data correctness, the Company shall not be liable in contract or tort or otherwise for any direct, indirect or consequential loss, damage or non delivery that may occur to the Customer as a result of such error or omission.

9. Confidentiality

The Company hereby states that all data collected from the Customer, will not be shared with any other Company or Party unless deemed absolutely necessary.

10. Without prejudice to any other rights which the Company may have, the Company shall be entitled to stop any goods either in manufacture or transit and may determine any contract forthwith and demand immediate payment of any amount due.

11. Usage of this Website

No unauthorised person may change, alter, deface or interfere with this website www.furniturezone.co.uk or any material contained herein.  furniturezone is a registered trademark.  furniturezone may not be used at any time for any purpose without written permission from the company.  Any person or company found to be using the trademark illegally will be prosecuted.

Privacy Statement

We are committed to protecting your privacy.  The information we collect from you (in accordance with the Data Protection Act 1998) and according to the Which? Web Trader Code of Practice, will be used solely by us to process your order and provide you with the best level of service.

We will not pass on, any information, to any other company without prior consent from yourself.

On this website, will we only take the following details from you:

your address

your daytime telephone number

your email address

No credit card details will be taken over the web site.  These will be taken by telephone when we contact you.

The information we hold will be held securely in accordance with our internal security policy and the law and the Which? Web Trader Code.

We may use technology to track the patterns of behaviour of visitors to our website.  This can include using a 'cookie' which would be stored on your browser.  You can usually modify your browser to prevent this happening.  The information collected in this way can be used to identify you unless you modify your browser settings.
